We have a long history of involvement in alternative dispute resolution dating back to the headship of the late Ronald Bernstein QC, who pioneered the development of arbitration and expert determination in the field of rent review.
Senior members of Chambers frequently act as arbitrators, independent experts and legal assessors. All of us act as advocates or advisers in arbitrations and disputes referred to experts. Several members of Chambers are Fellows of the Chartered Institute of Arbitrators. Members of Chambers are also often instructed by other independent experts and arbitrators to provide an opinion on a discrete point of law which has arisen in the proceedings.
We are actively involved in the development of mediation, which we fully support. All members of chambers are experienced in attending mediations on behalf of clients with a view to achieving a speedy and cost-effective settlement.
Disputes in our areas of practice are particularly well suited to these forms of dispute resolution. In particular, issues of the construction of documents are often referred to senior members of Chambers for expert determination. Such a procedure will normally be faster and more economic than court proceedings.Arbitration, too, has a number of advantages compared to court proceedings. The control of the proceedings is in the hands of the parties to a far greater extent than in court under the Civil Procedure Rules. The parties are able to select an arbitrator with known experience and ability in dealing with property related matters and arbitration can normally produce a decision faster than is possible in court.
